SECOND ADDENDUM TO RECORD OF PROCEEDINGS AIR FORCE BOARD FOR CORRECTION OF MILITARY RECORDS IN THE MATTER OF: DOCKET NUMBER: BC-2006-03623 COUNSEL: NONE HEARING DESIRED: NO _________________________________________________________________ REQUESTED ACTION: The former service member’s record be corrected to reflect award of the Silver Star (SS) Medal. _________________________________________________________________ RESUME OF CASE: On 26 Jun 07 and 29 Jul 10, the Board considered the applicant's (the deceased service member’s nephew) request to award his uncle the SS; the American Defense Service Medal (ADSM), with the Foreign Service Clasp; the Asiatic-Pacific Campaign Medal, with three Bronze Service Stars (APCM, w/3BSS); and that be he posthumously promoted to the grade of captain. The Board determined there was insufficient evidence to warrant corrective actions in regards to the SS and the ADSM and denied this portion of the application. However, they favorably considered the request for the APCM, w/3BSS . A complete copy of the Record of Proceedings (ROP) is at Exhibit G and the Addendum to ROP is at Exhibit M. By application, dated 9 Apr 12, the applicant requests reconsideration by introducing new evidence in the form of a blank order announcing the award of the SS. The applicant’s complete submission, with attachments, is at Exhibit N. _________________________________________________________________ THE BOARD CONCLUDES THAT: In earlier findings, the Board determined there was insufficient evidence to warrant corrective action. After thoroughly reviewing the additional documentation submitted in support of this appeal and the evidence of record, we do not believe the applicant has overcome the rationale expressed in our previous decisions. The applicant has submitted an order announcing the award of the SS; however, as the applicant points out, it is only a partial document and does not show the names of the recipients. We note there is no indication in this document that he was awarded the SS. Further, the Index Sheet does not state the decedent was the recipient of the SS. While we appreciate and honor the former service member’s service to his country, in view of the above and absent persuasive evidence showing the former member’s records are in error or unjust, the applicant’s request cannot be favorable considered. _________________________________________________________________ THE BOARD DETERMINES THAT: The applicant be notified that the evidence presented did not demonstrate the existence of material error or injustice; that the application was denied without a personal appearance; and that the application will only be reconsidered upon the submission of newly discovered relevant evidence not considered with this application. _________________________________________________________________ The following members of the Board reconsidered AFBCMR Docket Number BC-2006-03623 in Executive Session on 24 Sep 12 and 15 May 13, under the provisions of AFI 36-2603: , Panel Chair , Member , Member The following additional documentary evidence was considered: Exhibit M.
